The petitioner is given liberty to amend the cause title of

the revisional application to make the defacto complainant as

one of the opposite parties.

This is an application under Section 483 of the Code of

Criminal Procedure filed by the defacto complainant praying

for expeditious trial and disposal of the criminal proceedings

being G.R. Case No. 1087 of 2018 arising out of Duttapukur

Police Station Case No. 312 of 2018 dated the April 16, 2018

under Sections 498A/323/325/506/34 of the Indian Penal

Code pending before the learned Judicial Magistrate, 2nd

Court, Barasat.

While making his submission in favour of the petitioner

for expeditious disposal of the criminal proceedings, the

learned counsel has invited the attention of the Court to the

order dated May 23, 2019 passed in G.R. Case No. 1087 of

2018 and has submitted that the next date for appearance of

the accused has been fixed on May 17, 2021.

Having regard to the submissions made by learned

counsel appearing for the petitioner, the petitioner is directed

to serve the copies of the present revisional application along

with all annexed documents to the opposite party no. 1/the

State of West Bengal through the office of the learned Public

Prosecutor and to the added opposite party no. 2 by speed

post with acknowledgement due within one week from date

and to file affidavit-of-service within two weeks thereafter.

Let the matter appear in the list under the same

heading “Listed Motion” three weeks hence.

Urgent photostat certified copies of this order, if applied

for, be given to the parties upon compliance of all necessary

formalities.
