If that happens, it’s an opportunity for you to approach Hon’ble concerned High Court u/ s 482 of Cr.P.C. or under article 226/227 of Constitution of India. You can substantiate your claim of misuse of this act in your case as well as you can mention the arbitrary practices being adopted by concerned magistrate.
Whatever you mentioned sounds violations of your & Your family members fundamental rights and legal rights.
